These Terms of Service ("Terms") along with the Privacy Policy, govern your access to and use of 'Supafluent' (the "Service") operated by superfluid digital UG (haftungsbeschränkt) ("superfluid digital", "superfluid", "supafluent", "we", "us", or "our") related to website supafluent.com (the "Website"). By accessing or using our Service, you ("you", "your", or "User") agree to be bound by these Terms. Please read them carefully.

Unless otherwise required by law, we may not specifically notify you before making such changes before they go into effect. Once any updated Terms are in effect, you will be bound by them if you continue to use the Service. If you do not agree to our updated Terms, you can discontinue your use of the service at any time.

Supafluent is an AI-powered language learning platform that provides voice-first conversation practice across multiple languages. Our Service includes interactive learning modes (Echo, Shadow, and Mono), real-time AI coaching, pronunciation feedback, and scenario-based conversation practice.
You acknowledge and agree that we may send you emails related to your account and/or the Service, including but not limited to service updates, subscription notifications, and account security alerts.
Subject to your valid subscription or free tier usage limits, we grant you a non-exclusive, non-transferable, revocable right to access and use the Service. We will make our best efforts to deliver the Service for the duration of your valid subscription or free tier access. However, you acknowledge that unforeseen technical issues may arise that could temporarily affect the delivery or functionality of the Service, and we shall not be held liable for such issues.
The free tier provides 10 conversation sessions per month at no cost. This tier is available indefinitely and requires no payment information.
Access to unlimited sessions is provided on a monthly subscription basis. You agree to pay the applicable subscription fees as outlined on our Website. We reserve the right to change our subscription fees at any time, though we will notify users of any changes to their billing amounts.
If you are not satisfied with the Service, you have 14 days to cancel the service and receive a full refund. At the end of each billing period, the subscription will automatically renew indefinitely until explicitly cancelled by the User. Cancellation must be done via the Payment provider's customer portal.
Credits purchased through our pay-as-you-go option (minimum $2, 5 cents per session) never expire. Credits remain in your account until used. We also offer a 14-day trial period during which the credits can be refunded.
Eligible refunds will be issued to the credit card or PayPal account that was used to make the purchase, according to the refund policy described in the "Payment Terms" section. We will not issue cash refunds under any circumstances.
If you have a question about charges made to your account, please contact us immediately. If the charges were made in error, we will credit your account for the appropriate amount. We have a zero tolerance policy for chargebacks. Any customer who disputes a credit card payment that is found to be valid will be permanently banned from using the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SUPERFLUID DIGITAL UG (HAFTUNGSBESCHRÄNKT) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE.
We make our best efforts to ensure the consistent delivery and functionality of the Service. However, due to technical complexities and factors beyond our control, we cannot guarantee that the Service will function flawlessly at all times.
As a small, bootstrapped company, we are committed to providing the best possible service with the resources we have. You acknowledge that our capabilities and resources may differ from those of larger enterprise companies, and you agree that we shall not be held to the same standards or expectations.
All intellectual property rights in and to the Service, including but not limited to its design, code, content, AI models, and functionality, are owned by superfluid digital UG (haftungsbeschränkt). You are granted a limited right to use the Service as outlined in these Terms, but no ownership rights are transferred to you.

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Germany, to resolve any disputes arising out of or relating to these Terms or the Service.
VAT will be applied to the purchase price of the Service where applicable according to the tax laws of your country. Paddle, our payment processor, automatically handles VAT compliance based on your location:
Paddle manages all VAT calculations, collection, and remittance in accordance with local tax laws. You will see the final price including applicable VAT before completing your purchase.
We reserve the right to terminate or suspend your access to the Service at any time, with or without cause, and without prior notice. You may terminate your subscription at any time through your account settings or payment provider portal.
Monthly subscriptions will run to the end of the current billing period (4 weeks from billing date) during which time you will retain access to the Service. Free tier and pay-as-you-go users may stop using the service at any time.
You agree that regardless of any statute or law to the contrary, any claim or cause of action that you may wish to assert related in any manner to the Service must be filed within one (1) year after such claim or cause of action accrued or be forever barred.
These Terms constitute the entire agreement between you and superfluid digital regarding your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
We reserve the right to modify or update these Terms at any time. We will post the new Terms on our Website. Your continued use of the Service after the effective date of any such changes constitutes your acceptance of the revised Terms.
